Terms of service

The agreement

These terms are between your organization and Thrive Talent Development, Grand Rapids, Michigan. By subscribing, enrolling people in a program, or using the platform, your organization agrees to them. Individual learners use the platform under their employer's subscription and are bound by the acceptable use section.

What the service is

Thrive is a talent development function: live workshops and programs led by facilitators, a course library, and agents (ARIA on the marketing site; Morgan and Coach Taylor inside the platform) that handle setup, enrollment on request, coaching between sessions, and reporting. The platform underneath is provided so the function can be delivered; it is not sold on its own as software.

Pricing and billing

The organization subscription

• One flat price per organization, set by headcount band, published on the pricing page. Every employee of the organization is included. There is no per-seat platform charge and no implementation fee.
• A monthly plan is one month of access, charged once when you buy it. It does not renew on its own; we contact you before it ends and you choose whether to continue.
• Annual subscriptions are billed in advance for the year at the annual price on the pricing page. We contact you before the year ends to renew; nothing renews without your confirmation.
• If headcount grows past the band you are on, we will tell you and move you to the right band when you next buy a month or a year.

Program seats

• Public cohort seats, such as Fundamentals of Leading People, are priced per seat as published on the program page and billed when the seats are reserved.
• If a cohort does not run as scheduled, seats are refunded or moved to the next cohort, at your choice.
• A seat can be transferred to another person from your organization until the cohort starts. Seats not used after the cohort starts are not refunded.

The free compliance library

The compliance library is free for any organization and requires no card. There is no trial that converts into a paid subscription; a paid subscription starts only when you choose a band and pay for it.

Refunds

A monthly plan runs to the end of the month paid for and is not refunded for that month. Annual subscriptions canceled within thirty days of first purchase are refunded in full; after that they run to the end of the term. Cohort seats follow the program seat rules above.

Accounts and acceptable use

• Your organization's administrator creates accounts for its people and is responsible for keeping the list current.
• Accounts are for one person each. Keep the password private and tell us if you think it has been used by someone else.
• Do not use the platform to harass anyone, to upload content you do not have the right to share, to probe or overload the service, or for anything unlawful.
• Course material, films, workshop content, and program work product belong to Thrive or its licensors. They are for your organization's use and may not be resold or redistributed.
• Work you submit in a program stays yours. You grant us the right to use it to run the program and to give feedback on it.

The agents

ARIA, Morgan, and Coach Taylor generate their replies with a language model. They can be wrong. Prices quoted by ARIA are read from the same source as the pricing page; if a quote ever differs from the pricing page, the pricing page governs. Nothing an agent says is legal, financial, or medical advice.

Availability

We aim to keep the platform available at all times and schedule maintenance outside business hours where we can. Live sessions run on Microsoft Teams; if a session cannot run because of a failure on our side, it is rescheduled.

Ending the agreement

• You can cancel a monthly subscription at any time and an annual subscription before its renewal date, by writing to hello@thrivetalentdevelopment.com.
• We can suspend or end access for a breach of the acceptable use section, with notice where practical.
• After the subscription ends, your organization can request an export of its learning records at any time, and can ask us to delete them. We provide the export within thirty days of the request.

Liability

The service is provided as described on this site. We are not liable for indirect or consequential loss, and our total liability to your organization is limited to the amount you paid us in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.

Governing law

These terms are governed by the laws of the State of Michigan. Disputes are brought in the state or federal courts sitting in Kent County, Michigan.

Changes and contact

When these terms change, the date at the top changes with it, and material changes are sent to account administrators by email before they take effect. Questions go to hello@thrivetalentdevelopment.com.
